GENERAL

  1. All quoted prices are subject to standard VAT applicable at the time.
  2. Delivery, installation and set-up is NOT INCLUDED in our purchase or hire prices.
  3. It is the purchaser’s or hirer’s responsibility (and highly recommended by Metallo Design) to ensure they have all appropriate insurances, including Product and Public Liability insurance, from the point that the item(s) are delivered and installed by Metallo Design.
  4. It is the purchaser’s or hirer’s responsibility to ensure all safety measures are undertaken to comply with general Health & Safety and Fire Regulations.
  5. The purchaser or hirer should ensure they make themselves familiar with our guidelines in the Health & Safety Guidelines section of these terms & conditions.
  6. Metallo items are suitable for either indoor or outdoor use but the purchaser or hirer must advise on the location prior to delivery and installation.
  7. Every sculpture supplied by Metallo Design is unique and constructed from materials available at the time. If a purchase or hire is made based upon seeing another of our sculptures, whilst 90% of the design will be very similar there will always be differences between every design.
  8. Any resemblance of Metallo Design sculptures to existing characters whether real or fictional is pure coincidence.

ORDERING & PAYMENT

Purchase

  1. Where a purchase is made from our UK stock delivery can take up to 2 weeks.
  2. If we hold a sculpture in our overseas workshop delivery can take up to 5 weeks.
  3. Where a sculpture is not in stock or in the case of a bespoke order delivery can take up to 9 weeks.
  4. The date of order will be deemed to be the date the 50% deposit is paid.
  5. Payments can be made by cash, cheque or bank transfer.
  6. At the time of placing an order the purchaser is required to pay a 50% deposit of the quoted price. During the construction process we supply update photos and a full set of photos of the finished sculpture.
  7. The balance payment of the outstanding 50% must be paid upon approval of the final production photos where the sculpture is at our overseas workshop or photos of our items in stock in the UK. Any UK help sculptures may be viewed prior to payment upon appointment.

Hire

  1. A 50% deposit is required at the time of order with the 50% balance to be paid at least 3 days prior to delivery and installation.
  2. The delivery and installation/dismantling and collection fee will charged within 5 working days of the final collection.
  3. Extended hire charges will be applied to sculptures not returned within the agreed hire period and will be charged on a pro-rate basis.
  4. Hire charges are payable even if the sculpture is returned unused.
  5. The hirer assumes all responsibility and liabilities once the sculpture has been delivered and installed by Metallo Design or its representatives until they are collected by us.
  6. Where an accepted order cannot be fulfilled due to Metallo Design a full refund of any monies paid will be made.
  7. Any failed deliveries and collections will be charged for.
  8. Any unloading/loading which results in a parking penalty is payable by the hirer.
  9. A representative of the hirer must be available to meet the Metallo Design installation team.
  10. Where a hirer wishes to change a sculpture during the hire period Metallo Design reserve the right to supply from its available stock and additional delivery, installation and collection costs will be incurred.
  11. Metallo Design cannot be held responsible for any expense incurred between the hirer and their venue should they occur.
  12. Metallo Design cannot be held liable for any loss or damage either directly or consequentially in respect of loss of profits, business opportunity or goodwill.
  13. Any damage to items on hire will be charged for to return the item(s) to the condition in which they were supplied.

ORDER CANCELLATION

                Purchase

  1. If during the construction process the sculpture is not in accordance with the purchaser’s expectations then we will adapt the sculpture to match the purchase’s requirements. If upon viewing the final construction photos the purchaser is still not satisfied then the order can be cancelled and the 50% deposit fully refunded.
  2. Once a sculpture has been completed and signed off via the final construction photos the order cannot be cancelled and the purchaser is liable for the full agreed purchase price.

Hire

  1. Cancellation of any event or part thereof, within 12 months of the delivery date, will incur percentage cancellation fees of the hire charge value as follows:
  • Between 6 & 12 months before the first day of hire – 10%
  • Less than 6 months and more than 28 days before the first day of hire – 50%
  • Less than 28 days and more than 14 days before the first day of hire – 75%
  • Less than 28 days before the first day of hire – 100%

DELIVERY AND INSTALLATION

                Purchase

  1. All orders must be delivered and installed by Metallo Design trained operatives.
  2. Upon placing an order Metallo Design will conduct a site survey of the preferred location for the sculpture and advise accordingly.
  3. Large sculptures, 2m and bigger, must be located on a solid, level surface. Due to their construction sculptures do not require any additional support but should the purchaser require additional support Metallo Design will provide a cost for any additional work required.
  4. The site survey will also assess if suitable access and height is available for locating the sculpture. Our 3m sculptures require a minimum of 3.56m (11’ 6”) height. If access is considered too small we will make recommendations for alternative locations.
  5. Once in position should any damage be caused by the sculptures, e.g. damages floors due to being unsuitable for carrying the weight Metallo carry no responsibility.
  6. Access needs to be suitable for our lifting equipment.
  7. Metallo Design installers will take all care reasonable to protect walls, ceilings, etc from damage during the installation process but are not liable for any loss or damage deemed out of their control.
  8. Where a large sculpture is to be located on a non-concrete floor it is the purchaser’s responsibility to ensure the floor is sufficiently strong to hold the weight which will be in excess of 550Kg (1212 lb).
  9. Where a sculpture is to be located outdoors the ground must be level, firm and stable.
  10. Upon arrival, depending on conditions, it can take up to 4 hours to install a sculpture.

Hire

  1. All orders must be delivered and installed by Metallo Design trained operatives.
  2. Delivery and installation charges are quoted and charged separately.
  3. The hirer must ensure suitable access is available on the day of installation for the Metallo Design installation team.
  4. It is the hirer’s responsibility to arrange suitable access for the Metallo Design installation team where any special permission, security clearance, contractors passes, etc are required.
  5. The location requirements for sculptures are the same as those detailed in the Purchase section above.
  6. Where the sculpture is to be located on a special structure, such as an exhibition stand, platform, building entrance or shop window for example, it is the hirer’s responsibility to ensure there is suitable access and the location is sturdy enough for the sculpture.
  7. Once in position should any damage be caused by the sculptures, e.g. damages floors due to being unsuitable for carrying the weight Metallo carry no responsibility.
  8. If the sculpture is damaged in any way or, in the unlikely event of it being stolen whilst on hire the hirer must notify Metallo Design immediately not at the end of the hire term.
  9. Upon arrival, depending on conditions, it can take up to 4 hours to install a sculpture. Following installation the Metallo Design team will remove all their materials and equipment off site and return for dismantling and removal at the end of hire.
  10. It can take up to 4 hours to dismantle and remove a large sculpture and it is the hirer’s responsibility to ensure suitable access and sufficient time is available.
  11. Metallo Design will do it’s best to accommodate the hirer’s sculpture installation and removal dates and times but reserves the right to charge an additional fee for unsocial days and hours. All these fees will be agreed prior to installation.

HEALTH & SAFETY GUIDELINES

                Purchase & Hire

  1. If access to the general public is expected we recommend the sculptures are surrounded on all sides by a suitable barrier.
  2. We recommend signs advising not to touch or climb on the sculptures be prominently displayed.
  3. Once put in position by the Metallo Design trained operatives the client must not attempt to move or re-position the sculptures.
  4. Sculptures must only be erected, positioned and dismantled by trained Metello Design operatives.
  5. If located outdoors there are certain maintenance procedures that should be followed to maintain the integrity of the sculptures. (See Sculpture Maintenance Guidelines section)
  6. A 3m sculpture weighs approximately 550Kg (1212 lb) so it is essential they are positioned on a solid, flat surface that is capable of carrying the weight, once positioned it will not move. No special stabilisation cables or bolts are required. However, if a person, or persons, are determined to damage or push a sculpture over then it possible which is why we recommend barriers and signs are used to protect the sculpture and the hirer’s duty of care to the public.
  7. Metallo Design strongly recommends any customer Purchasing or hiring our sculptures carry their own Public and Product Liability insurance.
  8. Should there be any incident, be it injury of persons, damage, theft or any other circumstance indirectly involving our sculptures, the customer must inform Metallo Design immediately

SCULPTURE MAINTENANCE GUIDELINES

  1. Generally, our sculptures are strong and robust and very little care or maintenance is required.
  2. When every sculpture is finished it is polished, painted (if required) and lacquered to protect it from the elements.
  3. A superior quality lacquer is used to protect the sculpture when it is to be located outdoors. We recommend the lacquer is renewed every 3 years to prevent ingress of moisture which might result in corrosion and rust.
  4. However, many purchasers like to see wear, tear and even rust appear over time as they feel it adds to the sculpture’s authenticity of being constructed of recycled metal.
  5. If the sculpture has been painted then the paint will resist the weather for at least 5 years.
  6. When the statue is placed indoors it will last for decades and no further maintenance required unless it is damaged by misuse.
